General Terms & Conditions

These Terms & Conditions govern your use of our services, participation, and engagement with our organization. By accessing or participating in our programs, events, or online platforms, you agree to these terms.

Acceptance of Terms

  • By engaging with The Rainbow Society Of Medina County, whether through attending events, using our website, or participating in our programs, you agree to be bound by these Terms & Conditions and our Privacy Policy.

Purpose of the Organization

  • The Rainbow Society Of Medina County is dedicated to advocating for LGBTQ+ rights, promoting inclusivity, providing support, and raising awareness. Our activities are designed to foster a respectful and safe environment for all members and participants.

Conduct and Behavior

  • All members, volunteers, staff, and participants are expected to act with respect, kindness, and professionalism.
  • Discriminatory, hateful, or harassing behavior based on sexual orientation, gender identity, or any other characteristic will not be tolerated.
  • Participants must respect the views and identities of others and uphold the principles of inclusivity and diversity.

Respect for Privacy and Confidentiality

  • Participants are expected to respect others equally.
  • Personal information shared within our organization must not be disclosed without consent.
  • We do not tolerate the sharing of private or sensitive information outside of authorized contexts.
  • By supplying your email address you agree to be added to our email marketing campaigns for future updates regarding products, events services or other relevant material. You ma unsubscribe at any time by following the link at the bottom of the email.

Membership and Participation

  • Membership may be open to individuals who support the mission of The Rainbow Society Of Medina County.
  • Members must adhere to our code of conduct.
  • We reserve the right to suspend or revoke membership or participation privileges for violations of these Terms & Conditions.

Intellectual Property

  • All content, logos, and materials provided by The Rainbow Society Of Medina County are the intellectual property of the organization.
  • Unauthorized use, reproduction, or distribution of our content is prohibited unless explicitly permitted.

Contest Prizes

Event Policies

  • Participants attending our events agree to follow all event-specific rules and guidelines.
  • Attendees are responsible for their own safety and conduct during events.
  • The Rainbow Society Of Medina County is not liable for any injuries, damages, or losses incurred during participation.

Funding and Donations

  • Donations, vendor fees, participation fees and other monetary contributions are voluntary and NOT tax-deductible. All contributions made to the Rainbow Society are categorized as ADVERTISING expenses.
  • All donations will be used to support the organization’s mission and activities.
  • Refunds are generally not provided unless required by law or at our discretion.

Limitation of Liability

  • The Rainbow Society Of Medina County, it’s parent company KayCorp Inc. their employees, subsidiaries and affiliates shall not be liable for any damages, losses, or injuries resulting from participation in our activities, events, or use of our online platforms.

Changes to Terms & Conditions

  • We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated effective date. New terms notification sent annually via email. Continued participation after modifications indicates acceptance of the new terms.

Governing Law

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of The State of Ohio.

Submission of an application does not guarantee acceptance. All vendors and entertainers are subject to approval by event organizers. The event reserves the right to limit, relocate, or deny participation to maintain balance, safety, and mission alignment.

Vendor fees must be paid in full to reserve space. Fees are non-refundable unless the event is canceled by the organizer. Failure to submit payment by the stated deadline may result in forfeiture of space.

Events are “rain-or-shine” unless conditions are deemed unsafe. No refunds will be issued due to weather & Attractions may be moved inside or event may be rescheduled. If the event is canceled by the organizer, refunds or credits will be issued at the organizer’s discretion.

Vendors and entertainers must adhere to assigned setup and breakdown times. Early teardown is not permitted without approval. Participants must remain within their assigned space (10×10, 20×20, etc.). Vendors are responsible for their own tables, tents, weights, extension cords, and supplies unless otherwise stated.

Electricity is not guaranteed unless explicitly purchased or approved. Food vendors requiring electricity must disclose needs in advance. All cords and equipment must be provided by participant and be safe, secured, and compliant with venue rules.

Vendors are responsible for obtaining any required permits, licenses, or insurance. Food vendors must comply with all local health department regulations. Proof of insurance or permits may be requested prior to the event.

All participants must maintain professional, respectful conduct. Harassment, hate speech, or discriminatory behavior will not be tolerated. The Rainbow Society reserves the right to remove any participant whose conduct or content is deemed unsafe, inappropriate, or misaligned with the event’s values, without refund.

Vendors are responsible for all sales, transactions, taxes, and payment processing. Event organizers are not responsible for unattended, lost, stolen, or damaged items.

Entertainer-Specific Terms – Performance times and durations are assigned by the event organizer and are final. All performances must be approved by event organizers. Performers must arrive on time and be prepared to perform within their allotted slot. No explicit or unsafe content is permitted. Performers are responsible for any personal instruments, props, or costumes. Back-stage area will be available with limited space. Sets must be 40 Minutes or less. Entertainers will be contacted if additional information is needed.

Participants assume all liability and risk associated with participation. The rainbow Society, its parent company, employees & affiliates are not liable for injury, loss, or damage resulting from participation.

Media: The event reserves the right to photograph and record the event. Participation grants permission for use of images or recordings for promotional purposes without compensation.

Submission of an application and vendor fees constitutes agreement to all terms and conditions listed above.

Prize Resale & Transfer Policy

All prizes, awards, or promotional items (“Prizes”) provided by The Rainbow Society of Medina County are non-transferable, non-assignable, and intended solely for the winner’s personal use, unless otherwise explicitly stated in writing.

  • Winners may not sell, auction, trade, or otherwise transfer any prize without prior written permission from The Rainbow Society of Medina County for a period of 12 months from award delivery.

  • Unauthorized resale or distribution of a prize constitutes a violation of The Rainbow Society of Medina Couty’s terms and may result in one or more of the following actions at The Rainbow Society of Medina County’s discretion:

    • Revocation or repossession of the prize

    • Disqualification from current or future contests, promotions, or giveaways

    • Legal action to recover the prize, its value, or damages

The Rainbow Society of Medina County reserves the right to verify prize use and authenticity and may request proof that the prize is being used as intended including but not limited to photograph/video, receipts or other “reasonable” proof. Non-compliance may result in revocation of the prize or return of its full fair market value.

By accepting a prize, the winner agrees to comply with this policy and acknowledges that any attempt to sell or transfer the prize without authorization may result in immediate enforcement action.

No explicit or unsafe content is permitted.

Performers are responsible for any personal instruments, props, or costumes.

Back-stage area will be available with limited space.

Sets must be within the allotted time limits provided by event organizers.

Program Overview

Upon Approval MoE’s Closet provides participants with:

  • The program is free to participants.
  • Up to 10 clothing/fabric-based items per month
  • Up to 15 items per month when participating in a gently worn trade/swap
  • An additional 10 non-clothing items per month (see Section 6)

Eligible items may include clothing, shoes, bags, jewelry, accessories, bedding, personal care products, and other inventory available in the Closet.

 

Eligibility

Participation is open to individuals age 16+ who:

  • Demonstrate financial need, or
  • Are referred by an agency or outside source.

We serve any person in need of affirming assistance, regardless of gender identity, age, health condition, profession, background, or circumstance. This includes, but is not limited to:

  • Transgender and gender-diverse individuals
  • Individuals experiencing reproductive difficulties
  • Professionals lacking appropriate attire
  • Parents or caregivers in need of self-confidence support
  • Anyone seeking a judgement free safe, affirming space

 

Appointments, Privacy & Records

  • Upon approval participants are provided with information on their appointment time and location
  • Appointments are confidential and private.
  • If you require an appointment outside regular hours, please contact us to arrange accommodations.
  • We maintain participant records strictly for program tracking, reporting, and effectiveness.

Your personal information:

  • Will never be sold
  • Will never be shared without your consent
  • Will never be used publicly with identifying details

Anonymous testimonials may be used for promotional purposes. No identifying information will ever be disclosed.

By participating in the program, you agree to be added to one or more of our email communication lists for program updates, special offers, partnership benefits, and other relevant information beneficial to you. You may unsubscribe at any time.

 

Item Limits

10 Items – Monthly Clothing/”Large” Items Includes:

  • Clothing
  • Bags
  • Jewelry
  • Bedding
  • Shoes
  • Otherwise “Large” items

Participants may “swap” up to 15 items gently worn items.

Additional 10 Items “Other” Item Including:

  • Personal care products
  • Cosmetics
  • Condoms
  • Narcan or similar harm-reduction aids
  • Books from LGBTQ+ Book Love Ohio (2 per person per appointment)
  • Items categorized as “Other” by the program

Exceptions may be made in urgent situations, All exceptions are granted at program discretion.

 

Donation Guidelines

We accept donations of NEW & Gently Used:

  • Clothing
  • Shoes
  • Accessories
  • Personal care products
  • Intimate apparel (new/unused unless specified below)
  • Personal items
  • Partially used (“half-full”) personal care items such as lotions etc..  

Bras and binders

  • May be gently used and in good condition.

The following must be new or unused:

  • Undergarments
  • Intimatewear
  • Nipple pads
  • Shapewear
  • Cosmetics 

MoE’s Closet reserves the right to decline any donation deemed unsafe, unsanitary, or unfit.

We are not currently accepting:

  • Furniture
  • Large household goods
  • General household items
  • Pillows
  • Children’s items (please contact us for referral options)
  • Pet items

 

Usage Restrictions

Participants agree not to sell, transfer, barter, or commercially redistribute items received from MoE’s Closet for a period of one (1) year from the date of receipt.

If items are resold within that period, MoE’s Closet reserves the right to:

  • Recover the full fair market value of the item, plus
  • Recover any profit obtained from resale

Violation may also result in removal from the program.

Return & Redistribution Policy

We ask that when you are finished with items received from the Closet, you return them so others may benefit. If an item is no longer usable, you may responsibly discard it.

All donations received by MoE’s Closet may be:

  • Distributed through the program
  • Used internally
  • Otherwise Repurposed

Unless otherwise expressly indicated at the time of donation, all donated items become property of the program and may be used in any manner that supports the best interest of the organization.

We will make reasonable efforts to honor donor requests when explicitly stated, but the program retains final discretion.

  • Bedding deemed undesirable may be donated to an animal shelter.

 

Condition of Items & Risk Acknowledgment

We cannot guarantee the origin of any item.

We make reasonable efforts to clean, disinfect, and prepare used items prior to distribution. However:

  • All items are provided “as-is.”
  • We do not guarantee lifespan, durability, safety, or suitability.
  • We are not responsible for expiration dates, broken seals, or damaged packaging.

All Items are use at your own risk including but not limited to:

  • Clothing, shoes, accessories and products
  • “Half-full” or partially used personal care items (lotions, shampoos, cosmetics, etc.)
  • Sealed or packaged personal products
  • Non-perishable packaged food items
  • Contraception products (including condoms)
  • Harm reduction or emergency recovery aids (including Narcan or similar products)
  • Any medical or hygiene-related item
  • We are not responsible for the origin or condition of shoes, even if altered, adjusted, or modified

Client assumes all responsibility for any and all allergic reactions, medical complications, injury, or damages resulting from the use of any item received upon leaving.

Additional Resources

MoE’s Closet may provide information, referrals, or connections to outside services. We are not responsible for services provided by third-party organizations.

Legal Disclaimer & Limitation of Liability

By participating in this program, you acknowledge and agree that Participants assume all liability and risk associated with participation. The rainbow Society, its parents, affiliates, employees & advertisers are not liable for any injury, loss, or damage resulting from participation.

Participation constitutes full acceptance of these terms.
